BROKEN ARROW, Okla. — A jury trial will now decide whether Greg Neely, acting fire chief during 2004, was denied Broken Arrow Fire Department's top job and demoted in retaliation for an investigation into allegations of sexual harassment by three firefighters.

Neely, now deputy chief for fire prevention, filed suit Monday in U.S. District Court against the city.

He's seeking to be placed in the position of fire chief or be provided front, back and pension pay differentials plus interest on the back pay.
