Prosecutor: Berkeley, Calif., firefighter should be tried elsewhere

An Alameda County prosecutor said today that he thinks a former Berkeley firefighter should be prosecuted on felony child abuse charges in Nevada County before he’s prosecuted on misdemeanor charges for possession of child pornography in Alameda County.

Deputy District Attorney John Creighton said he believes “it makes more sense” for Luis Ponce, 49, of Grass Valley to stand trial first on the 21 felony counts against him in Nevada County because he faces a possible sentence of life in prison if he’s convicted of those charges.

Ponce, a paramedic supervisor who worked for the Berkeley Fire Department for 17 years before resigning last week, appeared briefly in Alameda County Superior Court today on the 57 misdemeanor counts he faces in the county.
