Cleveland firefighters’ union sues city, demands permanent chief

They say the city must choose from the current list of eligible candidates, rather than administer a new civil service promotional exam

CLEVELAND, Ohio — The Cleveland firefighters’ union has sued the city, arguing that Mayor Frank Jackson is violating state law by taking too long to appoint a new fire chief after former Chief Daryl McGinnis’ retirement last month.

And the union is demanding that Jackson choose from the current list of eligible candidates, rather than administer a new civil service promotional exam. The city’s Civil Service Commission has ruled that the current eligibility list is invalid because it contains fewer than three names, now that McGinnis has retired, according to the lawsuit, filed earlier this month in Cuyahoga County Common Pleas Court.

The City Charter, however, says the city can draw from a list that contains “three names or less,” the union argues. And although the charter is silent on how quickly the position must be filled, the lawsuit cites a section of state law that dictates that the city should make its choice within 10 days of the vacancy, if an eligibility list is available.
