DALLAS, Pa. — The Kunkle Fire Company announced the death of Firefighter Ed Nulton Sr., who was hit by a dump truck almost a year ago.
“We deeply regret to announce the passing of Firefighter Ed Nulton Sr. who passed away Thursday,” the Facebook statement read. “He wasn’t just a fireman; he was part of our family. Ed was a model part of our department that can never be replaced. His impact on our lives will forever be planted in our minds.”
Nulton was directing traffic at the scene of a vehicle crash on Sept. 21, 2018, when a dump truck struck Nulton, severely injuring him, the Citizen’s Voice reported.
Nulton was wearing a green florescent vest and carrying a lighted wind while directing traffic. He suffered a traumatic brain injury, brain bleeding, rib fractures, among other injuries.
According to the U.S. Fire Administration, Nulton was not able to recover from his injuries and passed away on Sept. 19, 2019.
The O’Donnell Law Offices representing Nulton’s family filed a lawsuit against the driver, Jack Husband Jr., and the dump truck company, Rexer’s LLC. The lawsuit also names Alan D. Shaver Sr. and his companies, Shaver & Sons, Inc. and Dominic’s Equipment Rentals, Sales and Service as defendants.
According to the lawsuit, the defendants showed a “reckless disregard for Federal Motor Carrier Safety Regulations.” The suit also states that Husband did not list any qualifications that would constitute him being qualified for the job and that Husband had a history of violations that included his commercial license being suspended.
In addition, the lawsuit alleges that Shaver was dishonest about a data recorder in the dump truck, implying that evidence was destroyed. The lawsuit is currently pending.
