LIBERTY, Ind. – The Liberty Volunteer Fire Department has the right to retain the monies it raises for the department, even though the town of Liberty has a contract with the department to make the department’s management decisions and receive taxes to support it.
Town attorney Jamie Harvey told the town council this week there are numerous legal opinions in Indiana law that show a fire department may retain money it raises because those monies are not public funds.
It doesn’t matter if the fire department uses the firehouse for fundraising activities such as breakfasts or dinners, or for taking family pictures as fundraisers, Harvey said Monday. The fundraising revenues belong to the fire department, not to the town, she said.
