Fallen firefighter’s family offered $400K in insurance money

Homeowner Mary Alice Mark agreed to pay the coverage to Gary and Linda Rose after Captain Jack Henry Rose died in a fire at her home

ULSTER COUNTY, N.Y. — The family of a fallen firefighter who died while fighting a house fire was offered $400,000 as a settlement from the homeowner.

Hudson Valley One reported that the family of Captain Jack Rose, a volunteer firefighter who died two years ago at the age of 19, was offered the money from homeowner Mary Alice Mark, who agreed to pay the full value of her insurance coverage.

The family’s attorney, Joseph O’Connor, said the family will most likely accept the settlement, which would be approved by the court in early 2018.

The Rose family sued Mark in 2016, accusing her of violating fire laws and residential codes by failing to fix the woodstove.

The State Department of Labor said Rose was separated from a hose line while battling the fire in the basement, and his breathing apparatus was not properly fitted. The Mount Marion and Centerville fire departments were issued multiple OSHA violations, including for failing to keep track of Rose’s whereabouts during the fire.
